Competitive Terms of Business at Jackson Rose

In these Terms & Conditions of business, Jackson Rose shall mean Jackson Rose (a division of Marketing Technologies Ltd a Limited Liability (Company Number 5919813) company whose registered office is at 843 Finchley Road London NW11 8NA)

These terms of business relate to the selection and recruitment services for permanent placing of personnel. For our contract resourcing services please see separate terms of business.

“Client” shall mean the interviewer of the applicant.

The “interviewer” shall mean the person who interviews the applicant introduced by Jackson rose.

“Recruitment campaigns” shall mean a campaign carried out by Jackson Rose to recruit permanent staff for a client.

“Search” shall mean being retained by the client to find particular individuals, which may involve advertising on a confidential basis.

Acceptance of Terms

The interviewing of an applicant introduced by Jackson rose will constitute acceptance of these terms and agreement by the client to pay Jackson Rose’s fee should an engagement of the application any capacity occur.

For the purpose of these terms & conditions an applicant shall have been introduced when Jackson Rose has supplied to a client the name of an applicant who is currently seeking employment.

An interviewer warrants that he is duly authorized to agree these terms on behalf of his firm, principal or employer as the case may be.

Notification

The client shall notify Jackson Rose immediately if the client engages an applicant introduced.

The engagement of an applicant by the client within eighteen months following the introduction shall constitute a contract between the client and Jackson Rose upon these terms of business.

Fees

All fees are based on the first year’s annual salary, which shall consist of the income guaranteed to the applicant by the client.

If a client engages an applicant introduced by Jackson rose, then the client shall pay to Jackson Rose the following recruitment fees:

Up to £29,999

18%

Between £30,000 - £49,999

20%

Over £49,999

22%

For applicants already engaged by the client on a contract basis, to whom the client subsequently offers permanent employment a fee of 20% of the applicant starting salary will be charged.

For clients retaining the services of Jackson Rose for search facilities, a retainer of 5% of the quoted annual salary for each person will be charged and a further 15% fee for each person subsequently engaged.

Payment

The client shall pay all invoices in full within 30 Days from the date thereof.

Value Added Tax shall be added to all invoices and shall be payable by the client.

Termination of the Engagement

In the event that the applicant leaves or is dismissed within eight weeks of the engagement being made then Jackson Rose will pay a rebate equal to 12.5% of the recruitment fee for each full week unworked.

Although Jackson Rose will make every effort to introduce suitable applicants for the clients vacancy we will not be liable for the situations where the applicant has made false claims as to his character or integrity.

Confidentiality

Introductions made by Jackson Rose are strictly confidential.

Liability

Jackson Rose accepts no liability for any loss or damage howsoever caused to anyone arising out of any act or omission by its agents or by any applicant.

It is the client’s responsibility to satisfy itself as to the correctness of any statement made.

The client is responsible for taking up references in respect of an applicant and for taking all reasonable steps, which a prospective employer would take in similar circumstances to secure the engagement of the applicant.

Jackson Rose Personnel

In the event of the client engaging or employing any person who was in the employ of Jackson Rose then a fee of 30% of the annual salary will be payable by the client to Jackson Rose.

Variation

No variation of these terms of business may be made without the written agreement of Jackson Rose. These terms of business replace any and all previous agreements.

Any variation in these terms offered will only remain in effect if the payment of the varied terms is made within 30 Days, or the agreed varied terms, of the applicant starting his term with the client. Jackson Rose reserves the right to invoice at the full rates on payments made after the 30 days, or agreed varied terms period.
